The publication Summary of rationales for climate litigation in Brazil: legal arguments for the inclusion of the climate variable in environmental licensing, developed by JUMA/PUC-Rio, with support from iCS, systematizes legal arguments to show that environmental licensing has its place guaranteed as a climate policy instrument.
The study provides theoretical, normative and jurisprudential basis for demanding the consideration of greenhouse gas (GHG) emissions from potentially polluting enterprises in environmental licensing. Historically relegated to a secondary role in the scope of climate governance, environmental licensing is one of the most important instruments for preventive control of environmental damage.
