The emergence of a new right in the Anthropocene: the human right to a safe and stable climate

Monograph submitted to the Law Department of PUC-Rio as a partial requirement for the Bachelor of Laws degree. The work advocates for the recognition of the human right to a safe and stable climate as a path to greater protection against the adverse effects of anthropogenic climate change in the Anthropocene era. The scenario of climate injustice becomes evident when we realize that those who have contributed least to the climate crisis are the most vulnerable to its negative impacts. The obstacles to effective responses to climate change are related to its ethical complexity, making it necessary to understand the climate issue from a human rights perspective. In this sense, based on the reading of legal doctrine and the analysis of the political-legal context of various regions of the world, it is clear that the recognition of the human right to a safe and stable climate is an emerging demand and should be considered as a strategy for achieving climate justice in the Anthropocene.
